CAS rejects Metalist appeal

Ukrainian soccer club Metalist Kharkiv were disqualified from European competition by UEFA following allegations of match-fixing

The Court of Arbitration for Sport (CAS) has turned down Metalist Kharkiv’s appeal against their disqualification from all UEFA competitions this season.

On Wednesday, UEFA banned Metalist from taking part in their upcoming Champions League play-off against Schalke for their alleged involvement in a case of match-fixing that dates back to April 19, 2008.

As a consequence of the UEFA ruling, it was announced that PAOK Salonika, who were eliminated from the third qualifying round of the competition by Metalist, would replace the Ukrainian side.

UEFA had stated that the decision was final, but Metalist were given the opportunity to appeal to CAS -- an offer which they accepted.

“I think that we will file it today. It’s already complete, because, in fact, we envisaged all possible options,” Metalist vice-president Kostiantyn Pyvoarov had told Interfax Ukraine.

However, on Friday, CAS announced in an official statement that it had turned down the Ukrainian side’s appeal.

“On 15 August, 2013, UEFA and PAOK FC each filed a written submission in response to the club’s request for provisional measures. After having considered the parties’ submissions, the deputy president of the Appeals Arbitration Division decided to dismiss FC Metalist’s request,” the statement read.

“Consequently, the UEFA decision remains in force, which means that FC Metalist Kharkiv is excluded from the 2013-2014 UEFA competitions.”

The decision means that PAOK will now definitely take Metalist’s place, while Maccabi Tel-Aviv, who were due to take on the Greek side in the Europa League play-offs, have now qualified directly for the group stage of the competition.
